Terms and Conditions of the Croatian Consular Portal - Notice to Applicants
I. General Provisions
§ 1
The Terms and Conditions define the rules for using the Croatian Consular Portal owned by the Ministry of Foreign and European Affairs, Trg N. Š. Zrinskog 7-8, 1000 Zagreb, Croatia.§ 2
For the purposes of these Terms and Conditions the following definitions apply:Registration Form – Form for Applicant to be filled with information required for the visa issuing process.
MFEA is the Ministry of Foreign and European Affairs - the owner of the Croatian Consular Portal.
Croatian Consular Portal is an online platform allowing individuals to register in the database of the service in order to arrange appointments in the chosen Consular Office as well as allowing to register electronically chosen application forms and supporting documentation required by law in order for the Consular Office to carry out consular tasks.
Applicant is a person using the Croatian Consular Portal.
II. Use of the Croatian Consular Portal
§ 3
1. Use of the Croatian Consular Portal is free and unrestricted.2. By using the Croatian Consular Portal the Applicant acknowledges and fully accepts these Terms and Conditions.
§ 4
To receive the service the Applicant agrees to:a. Accept these Terms and Conditions;
b. Correctly fill out all required forms and templates;
c. Submit all filled-out documents to be received by the Ministry of Foreign and European Affairs.
§ 5
By submitting the registration forms the Applicant confirms the authenticity and conformity with the actual state of data contained therein and recognition of the binding character of these Terms and Conditions.By using the Croatian Consular Portal for the purpose of registering applications via the Croatian Consular Portal, Applicant declares that he/she has read the instructions contained in the application and that they fully accept the conditions necessary to obtain the document to which the application relates. At the same time, the Applicant declares that all the data provided are correct and complete, and confirms that they have been warned that providing false information may result in rejection of the application or cancellation of the issued document.
Use of external programs and scripts supporting registration in the Croatian Consular Portal is unacceptable. Applications registered in this manner shall be rejected without right to complain.
§ 6
The MFEA shall reserve the right to refuse the registration of Applicant data.§ 7
The MFEA shall use the data provided by the Applicant exclusively for the purpose for which it was made available and shall not provide it to third parties.The Applicant who submitted applications via the Croatian Consular Portal shall simultaneously express their consent to the processing of personal data enclosed therein in accordance with the regulations in force, its storage and processing in the Visa Information System as well as consent to the release of the personal data to any authority competent for carrying out visa checks at external borders and on the territory of the Member States.
III. Obligations of Applicant
§ 8
Applicant using the Croatian Consular Portal shall comply with provisions on the general rules for use of the Internet.Any action inconsistent with the regulations set out herein shall constitute a liability and may be subject to legal proceedings against the Applicant.
IV. Disclaimer
§ 9
Access to the Croatian Consular Portal shall depend solely on the Applicant's internet access. MFEA cannot guarantee continuous use of the Croatian Consular Portal.§ 10
MFEA shall reserve the right to decide unilaterally on the contents of the Croatian Consular Portal, on any modification, suspension, or withdrawal of any element of the Croatian Consular Portal.MFEA shall be entitled to discontinue the availability of the Croatian Consular Portal without prior notification of its removal.
§ 11
MFEA shall not be liable for damages resulting from events that are beyond the control of the MFEA.MFEA shall not be liable for infringement of third-party rights or rules of general application in relation to any Applicant.
V. Privacy Policy
§ 12
All brand names and trademarks appearing on the Croatian Consular Portal are subject to copyright.Unless otherwise stated, the Croatian Consular Portal and its contents are protected by the Copyright Act and other related regulations. Copying and distribution, beyond applicant personal use, can be only done after obtaining a prior written consent of the MFEA and only to the extent indicated therein.
§ 13
Personal data contained in the Registration Form shall be processed by the MFEA, based in Zagreb, Trg N. Š. Zrinskog 7-8, 10000 Zagreb, Croatia, to the extent necessary to carry out the tasks for which the Croatian Consular Portal was created. The submission of personal data is entirely voluntary. However abstaining from the provision of the data required in the Registration Forms by the Applicant shall result in lack of service regularly provided on the Croatian Consular Portal.The Applicant has the right of access to their personal data and the right to make corrections as necessary.
The MFEA does not intend to share the Applicant`s personal data unless the requirement to share such data results from the provisions of generally applicable law in relation to services, which have been sought by the Applicant.
VI. Limitations
§ 14
The MFEA is not responsible for any damages caused by malfunction of the transmission system, including equipment failures, delays and disruptions in information transmissions on the applicant side.If required for security or other reasons, beyond the MFEA’s control, the MFEA may temporarily restrict access to the Croatian Consular Portal for the period required to remove the causes that are restricting access. In such cases, the MFEA shall not be held liable for the limitations to the availability of the Croatian Consular Portal.
VII. Final Provisions
§ 15
MFEA shall reserve the right to remove Applicant data in the event of a breach of the provisions of these terms and conditions or generally applicable law.§ 16
Any changes to the terms and conditions introduced by the MFEA shall be posted on the Croatian Consular Portal.Amendments to the terms and conditions are binding from the moment of their publications on the Croatian Consular Portal.
§ 17
Applicant rights and obligations are not transferable to a third party.§ 18
This Terms and Conditions shall be subject to Croatian law.The Croatian Consular Portal is regularly optimized and is prone to additional changes.
